MEMORANDO DE ENTENDIMENTO PARA O ESTABELECIMENTO DO PROGRAMA DIÁLOGOS ESTRATÉGICOS BRASIL-EUA A SER CELEBRADO ENTRE A FUNDAÇÃO COORDENAÇÃO DE APERFEIÇOAMENTO DE PESSOAL DE NÍVEL SUPERIOR (CAPES / MEC) E A COMISSÃO PARA O INTERCÂMBIO EDUCACIONAL ENTRE OS ESTADOS UNIDOS DA AMÉRICA E O BRASIL (COMISSÃO FULBRIGHT)

A Fundação Coordenação de Aperfeiçoamento de Pessoal de Nível Superior, doravante denominada CAPES, e a Comissão para o Intercâmbio Educacional entre os Estados Unidos da América e o Brasil, doravante denominada FULBRIGHT, ambas doravante denominadas “AS PARTES”:

Considerando o Acordo relativo à Cooperação em Ciência e Tecnologia entre a República Federativa do Brasil e os Estados Unidos da América, assinado em Brasília, em 2 de junho de 1984;

Considerando o Memorando de Entendimento sobre Educação entre o governo da República Federativa do Brasil e o Governo dos Estados Unidos da América, assinado em Washington, em 30 de março de 2007;

Considerando o Acordo entre o Governo da República Federativa do Brasil e o Governo dos Estados Unidos da América para Programas Educacionais e de Intercâmbio Cultural, firmado em Brasília, em 27 de maio de 2008; promulgado pelo Decreto Presidencial no 7.176, de 12 de maio de 2010; e,

Considerando o interesse em aprofundar a cooperação acadêmica entre instituições de ensino superior brasileiras e estadunidenses, a fim de promover o entendimento mútuo e o desenvolvimento da ciência e tecnologia em ambos os países.

Resolvem firmar, de comum acordo e de maneira a ser mutuamente benéfica, o presente Memorando de Entendimento.

ARTIGO I – DO OBJETO

1. Estabelecer o Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright) buscando aprofundar a cooperação entre acadêmicos de instituições brasileiras e estadunidenses em áreas que sejam mutuamente benéficas para as comunidades acadêmicas de ambos os países.

2. Fomentar a cooperação acadêmica e o intercâmbio entre pesquisadores de alto nível brasileiros e estadunidenses em programas de pós-graduação stricto sensu, mediante a visita de docentes e pesquisadores de alto nível a programas de pós-graduação stricto sensu ministrados no Brasil e nos EUA.

ARTIGO II – DOS OBJETIVOS

O objetivo do presente memorando de entendimento é, por intermédio do apoio ao Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright), promover:

1. A realização de palestras de alto nível, a serem oferecidas por professores visitantes estadunidenses no Brasil e brasileiros nos EUA, de elevado conceito internacional, para atuarem junto aos programas de pós-graduação stricto sensu brasileiros e estadunidenses, de modo a fomentar o intercâmbio acadêmico entre os dois países;

2. O incremento da formação de recursos humanos qualificados, fomentar a produção acadêmica e a formação de recursos humanos pós-graduados, contribuindo assim, para desenvolver capacidades, consolidar e ampliar o pensamento crítico em áreas estratégicas para o desenvolvimento de ambos países;

3. O fortalecimento e a ampliação de programas de pós-graduação stricto sensu de ambos países, envolvendo a participação articulada de diferentes programas de stricto sensu interessados no desenvolvimento do Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright).

ARTIGO III – DO FINANCIAMENTO

AS PARTES facilitarão e financiarão as atividades mencionadas por intermédio de seus programas regulares, até nove participantes brasileiros e até nove participantes estadunidenses, sendo três a cada ano.

ARTIGO IV – DA LEGISLAÇÃO VIGENTE

O presente Memorando de Entendimento será regido pelas leis e regulamentos em vigor no Brasil e nos EUA.

ARTIGO V – DA GESTÃO

1. Compete à CAPES, na gestão do Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright):

a. co-patrocinar a vinda de docentes e pesquisadores estadunidenses de alto nível para o Brasil por intermédio do Programa de Professor Visitante já existente;

b. co-patrocinar a ida de docentes e pesquisadores de alto nível brasileiros para os EUA; e

c. patrocinar a participação de docentes, pesquisadores e estudantes de pós-graduação brasileiros selecionados nos cursos.

2. Compete à FULBRIGHT:

a. co-patrocinar a vinda de docentes e pesquisadores estadunidenses de alto nível para o Brasil e a ida de docentes e pesquisadores de alto nível brasileiros para os EUA;

b. identificar, em conjunto com a CAPES, os programas de pós-graduação stricto sensu no Brasil e nos EUA interessados em abrigar cada edição do Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright); e

c. selecionar, em conjunto com a CAPES, os docentes e pesquisadores mencionados na alínea a. que participarão de cada edição do Programa Diálogos Estratégicos Brasil-EUA (CAPES/Fulbright).

ARTIGO VI – DA REPRESENTAÇÃO

A fim de coordenar as atividades do presente Memorando de Entendimento, a CAPES e a FULBRIGHT criarão um Comitê Gestor do Programa, constituído por um representante titular e um suplente da CAPES, um representante titular e um suplente da FULBRIGHT.

Caberá ao Comitê Gestor a solução e encaminhamento de questões técnicas, administrativas e financeiras que surgirem durante a vigência do presente Memorando de Entendimento, bem como a supervisão da execução dos trabalhos, consultando os respectivos superiores em cada entidade quando for o caso.

ARTIGO VII – DA PROPRIEDADE INTELECTUAL

Acerca da Propriedade Intelectual, o presente Memorando de Entendimento será implementado observando-se as legislações pertinentes no Brasil e nos EUA.

ARTIGO VIII – DA VALIDADE

Este Memorando de Entendimento entrará em vigor, por período de três anos, a partir da data de sua assinatura, podendo ser prorrogado por igual período de tempo, com a formalização de um novo documento.

ARTIGO IX – DAS ALTERAÇÕES

As condições estabelecidas no presente Memorando de Entendimento poderão ser alteradas, com as devidas justificativas, mediante proposta a ser apresentada no prazo mínimo de 180 (cento e oitenta) dias antes da data que se pretenda ter implementadas as alterações.

ARTIGO X – DA RESCISÃO

O presente Memorando de Entendimento poderá, a qualquer tempo, ser interrompido pelos partícipes, devendo o interessado externar formalmente a sua intenção nesse sentido, com a antecedência mínima de 90 (noventa) dias antes do encerramento do ano de trabalho. A denúncia não implica a paralisação das atividades em andamento, salvo se as partes convierem, de comum acordo, do contrário.

ARTIGO XI – DAS DISPOSIÇÕES FINAIS

As partes não serão responsabilizadas pelo não-cumprimento dos compromissos por motivo de força maior.

Casos omissos e questões não abrangidas explicitamente no texto do presente Memorando de Entendimento serão resolvidos entre AS PARTES.

Feito pela CAPES e pela FULBRIGHT em Brasília em 19 de março, de 2011, em duas vias originais, de igual teor e forma, devidamente assinados, em nome das duas PARTES.

MEMORANDUM OF UNDERSTANDING FOR THE ESTABLISHMENT OF THE BRAZIL-U.S.A. STRATEGIC DIALOGUE PROGRAM TO BE INAUGURATED BY THE BRAZILIAN FEDERAL AGENCY FOR THE SUPPORT AND EVALUATION OF GRADUATE EDUCATION (CAPES / MEC) AND THE COMMISSION FOR EDUCATIONAL EXCHANGE BETWEEN THE UNITED STATES OF AMERICA AND BRAZIL (FULBRIGHT COMMISSION)

The Brazilian Federal Agency for the Support and Evaluation of Graduate Education, hereafter CAPES, and the Commission for Educational Exchange between the United States of America and Brazil, hereafter FULBRIGHT, both hereafter referred to as THE PARTIES,

Whereas the Agreement on Cooperation in Science and Technology between the Federative Republic of Brazil and the United States of America, signed in Brasília on June 2, 1984;

Whereas the Memorandum of Understanding on Education between the governments of the Federative Republic of Brazil and of the United States of America, signed in Washington, D.C., on March 30, 2007;

Whereas the Agreement between the governments of the Federative Republic of Brazil and of the United States of America for Educational Programs and Cultural Exchange, signed in Brasília on May 27, 2008, and promulgated by Presidential Decree no. 7176, on May 12, 2010; and,

Whereas the interest in the deepening of cooperation between academic institutions of higher education in Brazil and the U.S.A. to promote mutual understanding and development of science and technology in both countries;

Resolve to sign, jointly and in a manner of mutual benefit, this Memorandum of Understanding.

ARTICLE I – PURPOSE

1. To establish the Brazil-U.S.A. Strategic Dialogue Program, endeavoring to deepen cooperation between scholars from institutions in Brazil and the U.S.A. in areas of mutual benefit to the academic communities of both countries.

2. To encourage scholarly cooperation and exchange between high-level Brazilian and American researchers in graduate programs, through the appointment of visiting professors and researchers of acclaim to graduate programs in Brazil and the U.S.A.

ARTICLE II – OBJECTIVES

The objective of this Memorandum of Understanding, through the Brazil-U.S.A. Strategic Dialogue Program, is to promote:
1. The delivery of high-level lectures, to be offered by internationally recognized American visiting professors in Brazil and by Brazilian visiting professors in the U.S.A., working together with graduate studies programs in Brazil and the U.S.A. in such a way as to promote academic exchange between the two countries;

2. An increase in skilled human resource training, the fostering of academic production and the training of human resources for graduate study, thus building capacity and consolidating and expanding critical thinking in strategic areas for the development of both countries;

3. The strengthening and expansion of graduate studies in both countries, involving the cooperative participation of different programs interested in the development of the Brazil-U.S.A. Strategic Dialogue Program.

ARTICLE III – FUNDING

THE PARTIES shall facilitate the activities mentioned through their regular programs and finance up to nine Brazilian participants and up to nine American participants, three of each during each year.

ARTICLE IV - LEGISLATION

This Memorandum of Understanding will be governed by the laws and regulations in force in Brazil and the U.S.A.

ARTICLE V – MANAGEMENT

1. It will be the responsibility of CAPES to:

a. Co-sponsor the visitation of American teachers and researchers in Brazil through the current Visiting Professor Program;

b. Co-sponsor the visitation of Brazilian teachers and researchers in the U.S.A.; and

c. Sponsor the participation of Brazilian teachers, researchers, and graduate students, selected in their departments.

2. It will be the responsibility of FULBRIGHT to:

a. Co-sponsor the visitation of American teachers and researchers in Brazil and of Brazilian teachers and in the U.S.A.;

b. Identify, together with CAPES, graduate programs in Brazil and the U.S.A interested in hosting yearly the Brazil-U.S.A. Strategic Dialogue Program;

c. Select each year together with CAPES the professors and researchers referred to in subparagraph a, who will participate in the Brazil-U.S.A. Strategic Dialogue Program.

ARTICLE VI – REPRESENTATION

To coordinate the activities of this Memorandum of Understanding CAPES and FULBRIGHT shall establish a Program Steering Committee, consisting of one representative and one alternate from CAPES, and one representative and one alternate from FULBRIGHT.

It shall be the responsibility of the Steering Committee to attend to technical, administrative, and financial issues arising during the term of this Memorandum of Understanding, and to supervise the implementation of activities, consulting superior personnel in each entity when appropriate.

ARTICLE VII - INTELLECTUAL PROPERTY

This Memorandum of Understanding will be implemented in compliance with the relevant laws in Brazil and the U.S.A.

ARTICLE VIII – VALIDITY

This Memorandum of Understanding will enter into force for a period of three years from the date of its signing and may be extended for an equal period of time, following the formalization of a new document.

ARTICLE IX – CHANGES

The conditions established in this Memorandum of Understanding may be amended by means of a proposal with supporting justification, to be submitted not more than 180 (one hundred and eighty) days before the date of commencement of the proposed changes.

ARTICLE X – TERMINATION

This Memorandum of Understanding may at any time be interrupted by the participants. In this case, the interested party (or parties) must formally express its (or their) intentions at least 90 (ninety) days before the end of the working year. This action does not imply the interruption of ongoing activities, unless THE PARTIES jointly agree to the contrary.

ARTICLE XI - FINAL PROVISIONS

THE PARTIES shall not be held responsible for non-fulfillment of commitments due to acts of God.

Omissions and matters not explicated in the text of this Memorandum of Understanding shall be taken up by THE PARTIES.

Signed by CAPES and FULBRIGHT in Brasilia on 19th of March, 2011 in two original copies of equal content and form, duly signed on behalf of both PARTIES.
