On July 7 and 8, Brazil and India
held joint consultations with the European Union in Geneva, within the “EU – Seizure of Generic
Drugs in Transit” dispute (DS409).
Throughout the
consultations and based on a list of nearly two hundred questions that were
forwarded in advance, Brazil questioned several aspects of the European
legislation on the seizure of drugs in transit through the Community territory,
under alleged suspicion of violations of intellectual property rules.
The queries aimed
at clarifying factual and interpretative aspects with regard to the actions of
the customs officials, the jurisprudence of national courts and of the European
Court of Justice. The goal of the consultations was also to obtain from the EU
relevant documents for the understanding of the case.
