O Governo da República Federativa do Brasil

e

O Governo da República Unida da Tanzânia
(doravante denominados “Partes”),

RECONHECENDO o espírito de cooperação existente entre os dois países; e

DESEJANDO promover estreita colaboração no treinamento de diplomatas,

Chegaram ao seguinte entendimento:

Artigo I

As Partes cooperarão em matéria de intercâmbio de informação e experiências acerca de seus programas de estudo e pesquisa, cursos, seminários e demais atividades acadêmicas, educacionais e de treinamento.

Artigo II

As Partes promoverão contato e intercâmbio de estagiários, estudantes, especialistas e pesquisadores.

Artigo III

As Partes estimularão estudo e pesquisa, bem como intercâmbio de informações sobre publicações nacionais e internacionais, especialmente em áreas de interesse mútuo.
Artigo IV

As Partes intercambiarão informações e visões relacionadas a tendências internacionais e a treinamento, estudo e pesquisa avançados em diplomacia, bem como ferramentas relativas à educação à distância.

Artigo V

As Partes apreciarão as possibilidades de outras formas de cooperação no âmbito do presente Memorando de Entendimento.

Artigo VI

As Partes decidirão, por via diplomática, as especificidades e a logística de cada projeto empreendido em conjunto. Para tal propósito, serão celebrados, caso necessário, protocolos estabelecendo os termos e as condições dos intercâmbios propostos.

Artigo VII

O presente Memorando de Entendimento é celebrado com o intuito de fortalecer a cooperação mútua entre as Partes e não implica qualquer compromisso de transferência de recursos financeiros entre as Partes ou qualquer outra atividade gravosa a seus patrimônios nacionais.

Artigo VIII

O presente Memorando de Entendimento entrará em vigor na data de sua assinatura e permanecerá em vigor por período de três anos, sendo renovado automaticamente por iguais períodos, exceto se denunciado por uma das Partes, mediante notificação escrita à outra, por via diplomática, noventa (90) dias antes do término de sua vigência. A denúncia deste Memorando não afetará projetos em execução, salvo em caso de decisão mútua em contrário das Partes.

Artigo IX

O presente Memorando de Entendimento poderá ser emendado, a qualquer momento, por consentimento mútuo das Partes, por via diplomáticas.

Artigo X

Qualquer controvérsia relativa à interpretação deste Memorando de Entendimento será resolvida por negociação direta entre as Partes por via diplomática.

Feito em Dar Es Salam, em 7 de julho de 2010, em dois originais, nos idiomas português e inglês, ambos os textos sendo igualmente autênticos.

MEMORANDO DE ENTENDIMENTO SOBRE COOPERAÇÃO EM INICIATIVAS DE REDD ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O GOVERNO DA REPÚBLICA UNIDA DA TANZÂNIA


O Governo da República Federativa do Brasil

e

O Governo da República Unida da Tanzânia
(doravante denominados como “Partes”),

CONSIDERANDO que o Brasil e a Tanzânia têm longo histórico de cooperação mútua e que ambos enfrentam problemas ambientais similares, em particular aqueles ligados aos impactos da mudança do clima, do desmatamento e da pobreza;

RECORDANDO que o Brasil e a Tanzânia são Partes na Convenção-Quadro das Nações Unidas sobre Mudança do Clima (UNFCCC);

CONSIDERANDO que o preâmbulo da UNFCCC reconhece que a natureza global da mudança do clima requer a maior cooperação possível de todos os países e sua participação em uma resposta internacional efetiva e apropriada, conforme suas responsabilidades comuns mas diferenciadas e respectivas capacidades e condições sociais e econômicas;

RECONHECENDO que ambas as Partes têm interesse comum em promover cooperação para implementar iniciativas relativas a mudança do clima e em desenvolver capacidades humanas no contexto de redução de emissões por desmatamento e degradação florestal (REDD), com base nos princípios da igualdade e do benefício mútuo;

ACREDITANDO que a implementação efetiva de REDD poderia contribuir para os esforços de mitigação e adaptação aos problemas relacionados à mudança do clima, e que a cooperação, tanto multilateral como bilateral, é de suma importância;

COMPARTILHANDO o compromisso de tratar as necessidades e as prioridades das comunidades locais e autóctones quando da implementação de ações de REDD;

ACREDITANDO que a cooperação bilateral entre as Partes na implementação de iniciativas de REDD continuará a promover a relação amigável entre os dois Países,

Chegaram ao seguinte entendimento:

Artigo 1
Objetivo

1.     O objetivo deste Memorando de Entendimento (doravante denominado “ME”) é desenvolver e promover cooperação em iniciativas de REDD, com base no benefício mútuo.

2.     O propósito principal da cooperação no âmbito deste ME é criar oportunidades para a troca de informações, tecnologia, conhecimentos técnicos e experiências em iniciativas de REDD e realizar atividades de cooperação nessa área.

Artigo 2
Escopo da Cooperação

As Partes cooperarão nas seguintes áreas prioritárias, entre outras:

a) monitoramento de desmatamento e degradação florestal;

b) tecnologias de manejo florestal;

c) monitoramento e controle ambiental;

d) manejo florestal sustentável;

e) reflorestamento;

f) abordagens para mobilização de fundos para apoiar variadas atividades de REDD.

Artigo 3
Atividades de Cooperação

Atividades de cooperação sob esse ME podem concentrar-se em temas de REDD como mecanismos de levantamento de fundos, governança e gestão de fundos, metodologias para a quantificação de reduções de emissões por desmatamento e outras atividades relacionadas à mudança do clima.  Essas atividades poderão incluir:

a) intercâmbio e compartilhamento de informações e dados sobre florestas;

b) intercâmbio de visitas de especialistas ambientais, cientistas e formuladores de políticas públicas;

c) provisão de oportunidades de treinamento; 

d) organização conjunta de seminários, oficinas e encontros;

e) implementação conjunta de projetos; e

f) outras formas de cooperação que possam ser decididas em conjunto pelas Partes.

Artigo 4
Implementação

1.    O Governo da República Federativa do Brasil designa o Ministério do Meio Ambiente como responsável pela implementação deste ME.

2.    O Governo da República Unida da Tanzânia designa o Gabinete do Vice-Presidente – Meio Ambiente como responsável pela implementação deste ME.

3.    Ambas as Partes envidarão seus melhores esforços para promover a implementação conjunta de projetos de cooperação nas áreas especificadas no Artigo 2.

Artigo 5
Direitos e Obrigações

1.     Nada nesse ME afetará direitos e obrigações dos Estados das Partes que derivem de quaisquer tratados, convenções ou acordos regionais e internacionais relacionados à proteção do meio ambiente dos quais elas sejam partes.

2.     As atividades de cooperação sob esse ME serão realizadas em conformidade com as leis e os regulamentos vigentes em cada País.

Artigo 6
Resolução de controvérsias

Quaisquer diferenças da interpretação ou implementação deste ME serão resolvidas amigavelmente por meio de consultas entre as duas Partes.

Artigo 7
Entrada em Vigor, Emendas e Denúncia

1.    Este ME entrará em vigor na data da sua assinatura.

2.    Este ME poderá ser emendado por consentimento mútuo por escrito das Partes.

3.    Qualquer Parte poderá notificar a outra, por escrito, de sua decisão de denunciar este MOU. A denúncia terá efeitos seis meses após a data da notificação

MEMORANDUM  OF  UNDERSTANDING  BETWEEN  THE  GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL  AND  THE  GOVERNMENT OF THE UNITED REPUBLIC OF TANZANIA ON MUTUAL COOPERATION IN TRAINING OF DIPLOMATS AT THE RIO BRANCO INSTITUTE OF FEDERATIVE  REPUBLIC OF BRAZIL AND THE CENTRE FOR FOREIGN RELATIONS OF THE UNITED REPUBLIC OF TANZANIA


The Government of the Federative Republic of Brazil

and

The Government of the United Republic of Tanzania
(hereinafter referred as “the Parties”),

RECOGNISING the spirit of cooperation that exists between the two countries; and

WILLING to promote closer collaboration on training of diplomats,

Have reached the following understanding:

Article I

The Parties will cooperate through exchange of information and experience concerning their respective programmes of study and research, courses, seminars and other academic, educational and training activities.

Article II

        The Parties will promote contact and exchange of trainees, students, experts and researchers.

Article III

        The Parties will encourage study and research, as well as exchange of information on national and international publications, especially in areas of mutual interest.

Article IV

        The Parties will exchange information and views related to international trends and advanced training, study and research in diplomacy as well as tools related to e-learning.

Article V

        The Parties will explore the possibilities of other forms of cooperation within the scope of this Memorandum of Understanding.

Article VI

        The Parties will decide, through diplomatic channels, the specifics and logistics of every project they jointly undertake. To this end, relevant protocols stipulating terms and conditions of such proposed exchanges will be concluded, if deemed necessary.

Article VII

    This Memorandum is concluded with a view to enhancing mutual cooperation between the Parties and does not constitute any commitment towards the transfer of financial resources between the Parties or any other activity onerous to their national treasury.

Article VIII

        This Memorandum will come into effect on the date of its signature and shall be valid for a period of three years, being automatically renewed for equal periods, unless terminated by any of the Parties by giving a written notice of ninety (90) days to the other Party prior to the date of termination. Such termination of this Memorandum will not affect ongoing projects, unless the Parties agree otherwise.

Article IX

        The present Memorandum of Understanding may be amended by mutual consent between the Parties, through diplomatic channels.

Article X

        Any dispute related to the interpretation of this Memorandum of Understanding shall be resolved by direct negotiations between the Parties, through diplomatic channels.

Done in duplicate at Dar Es Salaam, on this 7th day of July, 2010, in two original copies, in the Portuguese and English languages, both texts being equally authentic.

MEMORANDUM OF UNDERSTANDING ON COOPERATION IN REDD INITIATIVES BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE UNITED REPUBLIC OF TANZANIA


The Government of the Federative Republic of Brazil

and

The Government of the United Republic of Tanzania
(hereinafter referred to as the "Parties"),

CONSIDERING both Tanzania and Brazil have a long time mutual historical cooperation   and they face common environmental problems particularly those related to climate change impacts, deforestation and poverty;

RECALLING that Brazil and Tanzania are Parties to the United Nations Framework Convention on Climate Change (UNFCCC);

CONSIDERING that the preamble of the UNFCCC acknowledges that the global nature of climate change calls for the widest possible cooperation by all countries and their participation in an effective and appropriate international response, in accordance with their common but differentiated responsibilities and respective capabilities and their social and economic conditions;

RECOGNIZING that they have a common interest in promoting cooperation in  the implementation of climate change initiatives  and in building human capacity in the context of reducing emissions from Deforestation and forest Degradation (REDD) based on the principles of equality and mutual benefit;

BELIEVING that the effective implementation of REDD could contribute into the efforts towards mitigating and adapting to the global climate change problems and that cooperation at the bilateral and multilateral levels is of paramount importance;

SHARING the commitment to addressing local and indigenous communities needs and priorities as actions are taken on REDD;

BELIEVING that bilateral cooperation between the Parties in the implementation of REDD initiatives will further promote the friendly relations between the two countries,

Have reached the following understanding:

Article 1
Objective

1.     The objective of this Memorandum of Understanding (hereinafter referred to as the "MOU") is to develop and promote cooperation in REDD initiatives on the basis of mutual benefit.

2.     The main purpose of the cooperation under this MOU is to provide opportunities for the exchange of information, technology, expertise and experiences on REDD initiatives and to carry out cooperative activities in this area.

Article 2
Scope of Cooperation

The Parties will cooperate in the following priority fields, among others:

a) Monitoring deforestation and forest degradation

b) Forest management technology;

c) Environmental monitoring and control;

d) Sustainable Forest Management;

e) Reforestation;

f) Approaches for Mobilization of funds to support various REDD activities.

Article 3
Cooperative Activities

Cooperation activities under this MOU may focus on REDD issues such as fund raising mechanisms, fund governance and management, methodologies for quantification of reduced emission from deforestation and other climate change related activities.  These activities may include:

a)    Exchange and sharing of forest information and data;

b)    Exchange visits by environmental experts, scientists, and policy makers;

c)    Provision of training opportunities;

d)    Jointly organized seminars, workshops and meetings;

e)    Joint implementation of projects; and

f)    any other forms of cooperation that may be jointly decided upon by the Parties.

Article 4
Implementation

1.    The Government of the Federative Republic of Brazil designates the Ministry for the Environment as the responsible for the implementation of this MOU.

2.     The Government of the United Republic of Tanzania designates the Vice President’s Office - Environment as the responsible for the implementation of this MOU.

3.     Both Parties will make their best efforts to promote the joint implementation of cooperative projects in the fields stated in Article 2.

Article 5
Rights and Obligations

1.     Nothing in this MOU will affect the rights and obligations of State of the Parties deriving from any treaties, conventions, or regional or international agreements related to the protection of the environment, to which they are parties.

2.     The cooperative activities under this MOU will be carried out in accordance with each country's existing laws and regulations.

Article 6
Dispute Resolution

Any differences arising from the interpretation or implementation of this MOU will be resolved amicably through consultations between the two Parties.

Article 7
Entry into Effect, Amendment and Termination

1.     This MOU will come into effect on the date of its signature.

2.     This MOU may be amended by mutual written consent of the Parties.

3.      Any Party may notify the other, in writing, of its decision to terminate this MOU. The termination will be effective six months after the date of notification.
