I) MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND ON CULTURAL COOPERATION AND EXCHANGE

II) MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND CONCERNING A PARTNERSHIP FOR GLOBAL DEVELOPMENT

MEMORANDO DE ENTENDIMENTO ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O REINO UNIDO DA GRÃ-BRETANHA E IRLANDA DO NORTE SOBRE INTERCÂMBIO E COOPERAÇÃO CULTURAL

(doravante denominados "Participantes"),

Reconhecendo a tradicional cooperação entre o Brasil e o Reino Unido e cônscios da rica diversidade cultural de ambos os países, com vistas a fortalecer a colaboração entre os dois países em matéria de políticas culturais;

Considerando que a troca de experiências sobre políticas culturais e que a promoção do intercâmbio cultural entre os dois países proporcionam base sólida para suas relações bilaterais e contribuem para seu aprofundamento;

No contexto do Convênio Cultural entre o Governo do Reino Unido da Grã-Bretanha e Irlanda do Norte e o Governo da República Federativa do Brasil, assinado em 14 de outubro de 1976;

Chegaram ao seguinte entendimento:

1. Os Participantes concordam em desenvolver ações conjuntas de cooperação e intercâmbio cultural, concentradas no fortalecimento de seus laços culturais e no aumento do intercâmbio cultural entre indivíduos e instituições de ambos os países.

Áreas de Interesse

2. Os Participantes desenvolverão e promoverão ações envolvendo, principalmente, as seguintes áreas: Artes Performáticas (música, teatro, ópera, circo, dança); Artes Visuais (filme, fotografia, artesanato, TV e vídeo, belas artes, esculturas); Cultura Digital e Mídia Interativa (instalações eletrônicas, novas mídias); Literatura e Publicações; Arquitetura, Design e Moda; Economia Criativa; Patrimônio Cultural e Museus; e outras expressões culturais que enfatizem a diversidade cultural e a cidadania. Outras áreas de interesse podem ser incluídas pelos Participantes durante a implementação deste Memorando.

3. Os Participantes decidem, ainda, planejar e cooperar em várias atividades a serem desenvolvidas para lograr os objetivos da colaboração na área cultural, a saber:

a) desenvolvimento e manutenção de vínculos entre as instituições culturais, produtores, promotores e artistas de ambos os países;
b) intensificação do intercâmbio de artistas, especialistas, acadêmicos, autores, produtores e pessoas envolvidas em atividades culturais de diferentes áreas;
c) apresentações mútuas de trabalhos de artistas emergentes e incentivo à pesquisa e à experimentação de novas linguagens e expressões artísticas;
d) envolvimento de novos públicos e novas regiões em um rico ambiente cultural, por meio do acesso democrático ao conteúdo artístico;
e) colaboração entre artistas e residências artísticas;
f) programas de arte-educação, mecanismos de inclusão social através da cultura, liderança e desenvolvimento empresarial nos setores culturais;
g) desenvolvimento de intercâmbio e oportunidades na construção de conhecimento nos setores das artes e da Economia Criativa;
h) troca de informações e conhecimentos sobre indústrias criativas, políticas culturais e suas estruturas.

4. Ademais, os Participantes poderão explorar conjuntamente formas de cooperação multilateral com terceiros países com vistas a apoiar a realização dos objetivos estabelecidos no presente Memorando.

Linhas de Ação

5. Os Participantes identificam os seguintes itens como parte de um plano de ação estratégico no campo cultural que visa a promover o intercâmbio de suas expressões culturais, considerando a diversidade cultural dos dois países:

a) lançamento e implementação de programa conjunto com base na experiência britânica no programa "Connections through Culture", que abordará especificamente a construção e a manutenção de relações culturais, por meio de uma sequência de eventos, visitas mútuas, oficinas, seminários e conferências, incluindo atividades desenvolvidas no ambiente virtual;
b) esforços conjuntos para o envolvimento de outros parceiros, como agências governamentais brasileiras e britânicas, empresas privadas, instituições culturais, entidades e instituições acadêmicas internacionais, produtores independentes de conteúdos e outros, visando ao estabelecimento de uma rede de parcerias estratégicas e operacionais quando aplicável;
c) colaboração na área de Economia Criativa, através da transferência de expertise e de conhecimentos entre as indústrias criativas de ambos os países;
d) estabelecimento de diálogo sobre Educação Cultural e Cidadania Cultural, para examinar oportunidades de fortalecimento da cooperação bilateral em torno das questões referentes à cidadania, à juventude e ao desenvolvimento social através da cultura;
e) transferência mutua de conhecimento e metodologia entre órgãos e instituições envolvidos em programas de Legado Cultural e Olímpico e Paraolímpico em Londres e no Rio de Janeiro, que fazem parte das celebrações olímpicas nas duas cidades em 2012 e 2016.

Implementação

6. A fim de implementar amplo programa de relações culturais entre ambos os países e suas respectivas comunidades criativas e artísticas e indivíduos, os Participantes estabelecerão um Conselho Conjunto de Cooperação Cultural (doravante denominado "CCCC");

a) O CCCC terá representantes dos principais organismos e agências culturais a nível nacional dos dois países, a serem designados por ambos os Participantes. O CCCC reunir-se-á periodicamente, alternadamente no Brasil e no Reino Unido, a fim de tomar decisões estratégicas;
b) O CCCC apreciará e aprovará Plano de Ação apresentado pelo Ministério da Cultura do Brasil e pelo British Council Brasil, que submeterão, igualmente, plano de avaliação e detalhamento dos resultados.

Financiamento

7. Todos os recursos necessários para a implementação deste Memorando de Entendimento serão acordados caso a caso, de acordo com a disponibilidade de cada Participante, não excluindo outros tipos de financiamento a serem obtidos de terceiros.

a) Os Participantes poderão solicitar apoio complementar de agências não-governamentais e de outros organismos;

b) O presente Memorando não compromete expressamente ou de forma implícita suas agências vinculadas a financiar ações e propostas aqui estabelecidas.

Disposições Finais

8. Este Memorando de Entendimento terá efeitos na data de sua assinatura e permanecerá efetiva por um período de cinco (5) anos. Sua prorrogação poderá ser acordada por via diplomática;

9. Este Memorando de Entendimento poderá ser modificado de comum acordo entre os Participantes, por via diplomática;

10. Este Memorando de Entendimento poderá ser denunciado a qualquer momento, mediante um aviso por escrito, com antecedência mínima de três meses. A denúncia não afetará a implementação de arranjos, programas, atividades ou projetos em andamento, estabelecidos sob este Memorando antes da data de sua denúncia, a menos que os Participantes decidam de outra forma;

11. Este Memorando não cria qualquer direito ou obrigação perante as leis internacionais.

Assinado em Brasília, aos 21 dias do mês de junho de 2011, em dois exemplares, nos idiomas português e inglês, sendo ambos os textos igualmente válidos.

MEMORANDO DE ENTENDIMENTO ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O GOVERNO DO REINO UNIDO DA GRÃ-BRETANHA E IRLANDA DO NORTE SOBRE PARCERIA PARA O DESENVOLVIMENTO MUNDIAL

1. O Governo da República Federativa do Brasil e o Governo do Reino Unido da Grã-Bretanha e Irlanda do Norte (doravante denominados “Participantes”) reconhecem:

- a necessidade contínua de promover crescimento global que produza benefícios sustentáveis para os mais pobres, para reduzir a pobreza e alcançar os Objetivos de Desenvolvimento do Milênio;

- o sucesso significativo que o Brasil demonstrou no combate à pobreza, à fome, à desigualdade e à exclusão social dentro de suas fronteiras, bem como suas conquistas na cooperação internacional para o desenvolvimento;

- o forte comprometimento do Reino Unido com a redução da pobreza e os Objetivos de Desenvolvimento do Milênio, bem como seu trabalho contínuo no apoio desses por meio de mecanismos multilaterais e programas em países de baixa renda.

2. Os Participantes decidem desenvolver uma parceria para desenvolvimento global. O objetivo da parceria será o de cooperar para promover a redução da pobreza mundial, por meio de práticas e políticas melhoradas de desenvolvimento internacional.

3. A parceria entre os Participantes concentrar-se-á em aspectos como: cooperação em países de baixa renda; contribuição de seus respectivos países aos bens públicos mundiais; e futura configuração das agendas de desenvolvimento internacional dos respectivos países. A parceria buscará estimular maior ênfase na obtenção de resultados para as pessoas pobres, o que incluirá a promoção do fluxo de informações entre parceiros de desenvolvimento dos hemisférios norte e sul, com o objetivo de promover a cooperação e o aprendizado mútuo.

4. Os Participantes buscarão encorajar um diálogo de alto nível sobre questões de desenvolvimento mundial. O diálogo buscará considerar toda a amplitude de fatores que afetam a pobreza global e identificar maneiras com as quais a colaboração entre seus respectivos países pode contribuir para objetivos de desenvolvimento global.

5. Os Participantes buscarão encorajar o desenvolvimento de pesquisas e análises sobre o desenvolvimento global para instruir a parceria. Os Participantes buscarão encorajar contribuições para parceria de instituições não-governamentais, incluindo organizações da sociedade civil, instituições acadêmicas e centros de pesquisa, o setor privado e a imprensa.

6. Os Participantes concordam que futuras atividades no âmbito desta parceria serão determinadas posteriormente, baseadas em decisões conjuntas, incluindo atividades para as quais os Participantes poderão mobilizar recursos técnicos e financeiros.

7. Os pontos focais para a parceria serão o Diretor de Relações Internacionais do Ministério Britânico do Desenvolvimento Internacional (DFID) e o Diretor da Agência Brasileira de Cooperação (ABC) do Ministério das Relações Exteriores do Brasil.

8. Em conformidade com as políticas de transparência compartilhadas pelos Participantes, este Memorando de Entendimento e suas emendas subsequentes serão publicados no website do DFID e da ABC.

9. Este Memorando de Entendimento terá efeitos na data de assinatura por ambos os Participantes e permanecerá tendo efeito salvo se um Participante notificar o outro, por escrito e por via diplomática, de sua decisão de denunciá-lo. A denúncia não afetará a conclusão de qualquer projeto em andamento, exceto se os Participantes acordarem o contrário.

10. Este Memorando de Entendimento poderá ser emendado por consentimento mútuo escrito dos Participantes, por via diplomática. Qualquer disputa advinda da interpretação ou da implementação deste Memorando de Entendimento será resolvida por consultas diretas entre os Participantes.

11. O que precede representa o entendimento alcançado pelos Participantes sobre os assuntos referidos neste Memorando.

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND ON CULTURAL COOPERATION AND EXCHANGE

The Government of the Federative Republic of Brazil

And

The United Kingdom of Great Britain and Northern Ireland
(Hereinafter referred to as the “Participants”),

With regard to the traditional cooperation between Brazil and the United Kingdom, and mindful of the rich cultural diversity of both countries, to reinforce the collaboration on cultural policies between the two countries;

Considering that the exchange of best practices on cultural policies and the promotion of cultural interchange between the two countries provide a solid foundation for their bilateral relations and contribute to its consolidation,

In the context of the Cultural Convention between the United Kingdom of Great Britain and Northern Ireland and The Government of the Federative Republic of Brazil, signed on October 14 , 1976;

Have reached the following understanding:

1. The Participants agree to develop joint actions of cultural cooperation and exchange focused on strengthening their cultural bonds and increasing the cultural interchange between individuals and institutions from both countries.

Areas of Interest

2. The Participants will develop and promote actions involving mainly the following areas: Performing Arts (music, theatre, opera, circus, dance) ; Visual Arts (film, photography, crafts, TV & video, fine arts, sculptures) ; Digital Culture and Interactive Media ( electronic installations, new media) ; Literature and Publishing; Architecture, Design and Fashion; Creative Economy; Cultural Heritage and Museums; and other cultural expressions and activities that emphasize cultural diversity and citizenship. Other areas of interest may be decided by the Participants during the implementation of this Memorandum.

3. Additionally, the Participants decide to plan and cooperate in a number of activities designed to attain the goals of cultural collaboration, namely:

a) Development and maintenance of links between cultural institutions, producers, promoters and artists in both countries;
b) Intensification of the exchange of artists, experts, academics, authors, producers and individuals engaged in cultural activities from different areas;
c) Mutual presentations of work from emerging artists, and incentive on the research and experimentation of new artistic languages and expression;
d) Engagement of new audiences and new regions in a rich cultural environment through democratic access to artistic contents;
e) Collaborations between artists, and artistic residencies;
f) Arts education programs, mechanisms of social inclusion through culture, and leadership and entrepreneurial development in the cultural sectors;
g) Development of exchange and opportunities in capacity building in the arts and creative economy sectors;
h) Exchange of information and knowledge on creative industries, cultural policies and structure.

4. Furthermore, the Participants may jointly explore forms of multilateral cooperation with third countries with a view to supporting the attainment of goals set out in this Memorandum.

Lines of Action

5. The Participants identify the following as part of a strategic action plan in the cultural field that aims to promote the exchange of their cultural expressions, taking into account the cultural diversity from both countries:

a) Launching and implementation of a joint programme based on the British experience of “Connections through Culture”, which will specifically address the building and maintenance of cultural relationships through an ongoing series of events, mutual visits, workshops, seminars and conferences, including web-based activities;
b) Joint efforts towards the engagement of third parties, such as Brazilian and British governmental agencies, private companies, cultural institutions, international societies and academia, independent content producers and others, aiming the establishment of a network of strategic and operational partnerships when appropriate;
c) Collaborations in the area of Creative Economy through the transfer of expertise and knowledge between the creative industries from both countries;
d) Establishment of a dialogue on Cultural Education and Cultural Citizenship to study opportunities for strengthening bilateral cooperation around the issues of citizenship, youth and social development through culture;
e) Mutual transfer of knowledge and methodology between agencies and institutions engaged in Cultural and Olympic and Paralympic Legacy programmes in London and Rio de Janeiro which form part of the Olympic celebrations in the two cities in 2012 and 2016.
Governance

6. In order to implement an extensive programme of cultural relations between both countries and their respective creative and artistic communities and individuals, the Participants will establish a Joint Cultural Cooperation Board (hereinafter referred to as “JCCB”);

a) The JCCB will have representatives of the principal cultural agencies and bodies at national level in the two countries to be appointed by both Participants.The JCCB will meet periodically, alternatively in Brazil and in the United Kingdom, in order to make strategic decisions;
b) The JCCB will consider and approve an Action Plan presented by the Brazilian Ministry of Culture and the British Council Brazil, which will also submit an evaluation plan and detailed achievements.

Funding

7. All necessary resources for the implementation of this Memorandum of Understanding should be decided on a case-by-case basis, according to each party’s availability, not excluding other types of funding to be obtained from third parties;

a) The Participants are entitled to seek additional support from non-governmental agencies and bodies;
b) This Memorandum does not expressly or implicitly commit the Participants and their nominated agencies to fund the actions and intents set out within it.

Concluding Provisions

8. This Memorandum of Understanding will come into effect on the day of its signature and will be effective for a period of five (5) years. Further extensions may be decided upon through diplomatic channels;

9. This Memorandum of Understanding can be amended as decided by the Participants through diplomatic channels;

10. This Memorandum of Understanding may be terminated at any time upon a three-month notice in writing prior to the intended date of termination. This will not affect the implementation of on-going arrangements, programmes, activities or projects which have been decided under this Memorandum prior to date of its termination, unless the Participants decide otherwise;

11. This Memorandum does not create any right or commitment under international laws.

MEMORANDUM OF UNDERSTANDING BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND
CONCERNING A PARTNERSHIP FOR GLOBAL DEVELOPMENT

1. The Government of the Federative Republic of Brazil and the Government of the United Kingdom of Great Britain and Northern Ireland (hereinafter referred to as “Participants”) note:

- the continuing need to promote global growth which produces sustainable benefits for the poor, to reduce poverty and to achieve the Millennium Development Goals;

- the significant success which Brazil has demonstrated in tackling poverty, hunger, inequality and social exclusion within its borders, and its achievements in international development cooperation;

- the United Kingdom's strong commitment to poverty reduction and the Millennium Development Goals and its continued work in support of these, through multilateral channels and programmes in low income countries.

2. The Participants hereby decide to develop a partnership on global development. The aim of the partnership will be to cooperate to promote global poverty reduction, including through improved international development policy and practice.

3. The partnership between the Participants will include a focus on: cooperation in low income countries; the contribution of their respective countries to global public goods; and the future shape of the international development agenda of their respective countries. The partnership will seek to encourage an increased focus on delivering results for poor people. This will include encouraging the flow of information between development partners in the global north and south with the aim of promoting cooperation and mutual lesson learning.

4. The Participants will aim to encourage high level dialogue on global development issues. The dialogue will aim to take account of the full range of factors affecting global poverty and identify ways in which collaboration between their respective countries can contribute towards global development goals.

5. The Participants will aim to encourage the development of research and analysis on global development to inform the partnership. The Participants will encourage contributions to the partnership from non-governmental institutions including civil society organizations, academic institutions and think-tanks, the private sector and the media.

6. The Participants decide that future activities under this partnership will be formulated at a later date, based on jointly decided procedures, including activities for which the Participants may mobilize technical and financial resources.

7. The focal points for this partnership will be the Director, International Relations of the Department for International Development (DFID) and the Director of the Brazilian Cooperation Agency (ABC) of the Ministry of External Relations of Brazil.

8. In the interests of transparency shared by the Participants, this Memorandum of Understanding and any subsequent amendments will be published on DFID’s and ABC’s websites.

9. This Memorandum of Understanding will come into effect upon the date of its signature by both Participants and will continue in effect unless either Participant notifies the other in writing, through diplomatic channels, of its decision to terminate it. The termination will not prejudice the completion of ongoing projects, unless the Participants agree otherwise.

10. This Memorandum of Understanding may be amended by mutual written consent of the Participants through diplomatic channels. Any dispute arising from the interpretation or implementation of this Memorandum of Understanding will be resolved by direct consultations between the Participants.

11. The foregoing represents the understandings reached between the Participants upon the matters referred to therein.
