MEMORANDO DE ENTENDIMENTO SOBRE COOPERAÇÃO MÚTUA ENTRE O INSTITUTO RIO BRANCO DO MINISTÉRIO DAS RELAÇÕES EXTERIORES DA REPÚBLICA FEDERATIVA DO BRASIL, O INSTITUTO DE SERVIÇO EXTERIOR DO MINISTÉRIO DE NEGÓCIOS ESTRANGEIROS DA REPÚBLICA DA ÍNDIA E A ACADEMA DIPLOMÁTICA DO DEPARTAMENTO DE RELAÇÕES INTERNACIONAIS E COOPERAÇÃO DA REPÚBLICA DA ÁFRICA DO SUL

O Instituto Rio Branco do Ministério das Relações Exteriores da República Federativa do Brasil, o Instituto de Serviço Exterior do Ministério de Negócios Estrangeiros da República da Índia e a Academia Diplomática do Departamento de Relações Internacionais e Cooperação da África do Sul (doravante denominados os "Institutos"),

RECONHECENDO o espírito de cooperação existente entre seus países; e

DESEJANDO promover estreita colaboração entre os Institutos,

Chegaram ao seguinte entendimento:

ARTIGO I

O objetivo deste Memorando de Entendimento é criar as bases para estreitar a cooperação e facilitar a colaboração entre os Institutos.

ARTIGO II

Os Institutos cooperarão em áreas de interesse mútuo, que poderão incluir, entre outras coisas, troca de informações sobre estrutura e conteúdo de programas de treinamento; tendências e avanços internacionais em treinamento; técnicas e uso de tecnologia para treinamento, incluindo concepção e preparação de conteúdo para ensino a distância por meio eletrônico; bem como identificação de especialistas e pesquisa conjunta em áreas mutuamente acordadas.

ARTIGO III

Os Institutos intercambiarão experiências, informações e publicações em temas de interesse comum, incluindo programas de treinamento, currículos de estudos, e outras atividades acadêmicas, educacionais e de treinamento promovidas pelos Institutos no campo da diplomacia e outras atividades de interesse comum.

ARTIGO IV

Os Institutos promoverão o intercâmbio de peritos, acadêmicos e diplomatas em treinamento.

ARTIGO V

Os Institutos encorajarão pesquisa coordenada, estudos conjuntos e seminários em temas de interesse mútuo.

ARTIGO VI

Os Institutos poderão examinar, de comum acordo, a factibilidade de quaisquer outras formas de cooperação que possam ser mutuamente benéficas.

ARTIGO VII

Os Institutos decidirão os pormenores e a logística de cada projeto empreendido conjuntamente. Será celebrado com essa finalidade, caso necessário, protocolo estabelecendo termos e condições dos intercâmbios propostos.

ARTIGO VIII

1. Este Memorando de Entendimento surtirá efeito na data de sua assinatura e permanecerá em aplicação por período de três anos, a partir de então renovável automaticamente, a cada vez, por período adicional de três anos, exceto se denunciado por um dos Institutos mediante comunicação escrita aos outros Institutos ao menos três meses antes da expiração de seu período de validade.

2. Qualquer dos Institutos poderá, a qualquer momento, notificar os demais, por via diplomática, de sua intenção de denunciar o presente Memorando de Entendimento. A denúncia surtirá efeito noventa (90) dias após a data da notificação e não afetará os projetos em execução, salvo se acordado em contrário pelos Institutos.

3. O presente Memorando de Entendimento poderá ser emendado a qualquer momento, por consentimento mútuo dos Institutos, por via diplomática.

Em fé do que, os abaixo assinados, devidamente autorizados firmaram o presente Memorando de Entendimento em Pretória, em 18 de outubro de 2011, em três originais, nos idiomas português, híndi e inglês, sendo todos os textos igualmente autênticos. Em caso de divergência de interpretação, o texto em inglês prevalecerá.

MEMORANDUM OF UNDERSTANDING ON MUTUAL COOPERATION AMONG THE RIO BRANCO INSTITUTE OF THE MINISTRY OF EXTERNAL RELATIONS OF THE FEDERATIVE REPUBLIC OF BRAZIL, THE FOREIGN SERVICE INSTITUTE OF THE MINISTRY OF EXTERNAL AFFAIRS OF THE REPUBLIC OF INDIA AND THE DIPLOMATIC ACADEMY OF THE DEPARTMENT OF INTERNATIONAL RELATIONS AND COOPERATION OF THE REPUBLIC OF SOUTH AFRICA

The Rio Branco Institute of the Ministry of External Relations of the Federative Republic of Brazil, The Foreign Service Institute of Ministry of External Affairs of the Republic of India and the Diplomatic Academy of the Department of International Relations and Cooperation of South Africa (hereinafter referred to as the "Institutes"),

RECOGNISING the spirit of cooperation that exists among their respective countries; and

DESIRING to promote closer collaboration among the Institutes,

Have reached the following understanding:

ARTICLE I

The objective of the present Memorandum of Understanding is to create a framework for closer cooperation among the Institutes and to facilitate collaboration among them.

ARTICLE II

The Institutes will cooperate in areas of mutual interest, which inter alia may include exchange of information on structure and content of training programmes, international trends and advances in training, training techniques and the use of technology in training, including design and content of e-Iearning; as well as identification of experts and joint research in mutually agreed areas.

ARTICLE III

The Institutes will exchange experience, information and publications on subjects of common interest, including training programmes, curricula of studies, and other academic, educational and training activities undertaken by the Institutes in the field of diplomacy and other activities of common interest.

ARTICLE IV

The Institutes will promote the exchange of experts, scholars and diplomatic trainees.

ARTICLE V

The Institutes will encourage coordinated research, joint studies and seminars on subjects of mutual interest.

ARTICLE VI

The Institutes may explore the possibilities of any other form of cooperation which can be mutually beneficial and is mutually agreed upon.

ARTICLE VII

The Institutes will decide the specifics and logistics of every project they jointly undertake. For this purpose, a protocol laying down the terms and conditions of the proposed exchanges will be concluded, if necessary.

ARTICLE VIII

I. This Memorandum will come into effect on the date of its signature and will continue to have effect for a period of three years, and thereafter will automatically stand renewed for similar three year periods at a time, unless terminated by any of the institutes by giving a written notice to the other Institutes, at least three months before the expiry of its period of validity.

2. Any of the Institutes may, at any time, notify the other, through diplomatic channels, of its intention to terminate the present Memorandum of Understanding. Termination will be effective ninety (90) days after the date of the notification and will not affect the ongoing projects, unless otherwise agreed upon by the Institutes.

3. The present Memorandum of Understanding may be amended at any time, by mutual consent of the Institutes, through diplomatic channels.

IN WITNESS WHEREOF, the undersigned, being duly authorised therefore, have signed this Memorandum of Understanding at Pretoria on the 18th day of October month of 2011 in three originals, in the Portuguese, Hindi and English languages, all texts being equally authentic. In case of any divergence in interpretation, the English text shall prevail.
