ACORDO ENTRE O GOVERNO DA REPÚBLICA FEDERATIVA DO BRASIL E O GOVERNO DAS BAHAMAS SOBRE A ISENÇÃO DE VISTO PARA PORTADORES DE PASSAPORTES DIPLOMÁTICOS, OFICIAIS OU DE SERVIÇO

O Governo das Bahamas
(doravante denominados “Partes”),

Movidos pela vontade de fortalecer o relacionamento entre os dois países;

Desejosos de facilitar a entrada em seus territórios de nacionais de cada uma das Partes portadores de passaportes diplomáticos, oficiais ou de serviço,

Acordam o seguinte:

Artigo 1

Cidadãos de cada uma das Partes, portadores de passaportes diplomáticos, oficiais ou de serviço válidos, não acreditados no território da outra Parte, poderão entrar, sair, transitar e  permanecer do território da outra Parte, sem a necessidade de visto, por um período máximo de 90 (noventa) dias, contados a partir da data da entrada.

Artigo 2

1.    Prorrogação do período de que trata o Artigo 1 poderá ser concedida pelas autoridades competentes do Estado acreditado mediante solicitação por escrito da Missão diplomática ou da Representação consular do Estado acreditante.

2.    No caso de não existir Missão diplomática ou Representação consular de uma das Partes, portadores de passaportes diplomáticos, oficiais ou de serviço poderão consultar o Departamento Consular do Ministério de Relações Exteriores do Estado acreditado.

Artigo 3

Cidadãos de cada uma das Partes, portadores de passaportes diplomáticos, oficiais ou de serviço válidos, que sejam membros de Missão diplomática ou Representação consular acreditados no território da outra Parte, bem como os seus dependentes que com eles morem e que sejam portadores de passaportes diplomáticos, oficiais ou de serviço válidos, poderão entrar, sair, transitar e permanecer no território da outra Parte, sem a necessidade de visto, durante todo o período da sua missão, desde que tenham cumprido as exigências de acreditamento da outra Parte em até 30 dias após a chegada no território da outra Parte.

Artigo 4

Os cidadãos mencionados neste Acordo poderão entrar e sair do território da outra Parte em todos os pontos de entrada abertos ao tráfego internacional de passageiros.

Artigo 5

Os cidadãos das Partes deverão, durante a sua permanência no território da outra Parte, respeitar a legislação vigente.

Artigo 6

Este Acordo não restringe o direito de cada Parte de recusar a entrada ou abreviar a permanência de cidadãos da outra Parte considerados indesejáveis.

Artigo 7

Se um cidadão de uma das Partes perder seu passaporte diplomático, oficial ou de serviço no território da outra Parte:

a)    o cidadão deverá informar as autoridades competentes do país receptor e requerer ação apropriada, e

b) a Missão diplomática ou Repartição consular interessada deverá emitir novo passaporte diplomático, oficial ou de serviço ou documento de viagem ao referido cidadão e informar as autoridades competentes no país receptor.

Artigo 8

1.    As Partes deverão intercambiar, por via diplomática, espécimes de passaportes diplomáticos, oficiais ou de serviço válidos, mencionados neste Acordo, no prazo máximo de 30 (trinta) dias após a data de assinatura deste Acordo.

2.    Caso haja introdução de novos passaportes diplomáticos, oficiais ou de serviço ou modificação dos existentes, as Partes deverão intercambiar, por via diplomática, espécimes de seus novos passaportes, acompanhados de informação pormenorizada sobre suas características e uso, com a antecedência mínima de 30 (trinta) dias de sua utilização.

Artigo 9

Cada uma das Partes poderá suspender a aplicação total ou parcial deste Acordo por motivo de segurança, de ordem pública ou de saúde pública. A adoção de tais medidas, assim como sua revogação, deverá ser comunicada à outra Parte, no prazo mais breve possível, por via diplomática.

Artigo 10

13. Este Acordo será válido por tempo indeterminado e entrará em vigor 90 (noventa) dias após o recebimento da segunda Nota diplomática em que as Parte informam-se  sobre o cumprimento dos respectivos requerimentos legais para sua entrada em vigor.

14. Este Acordo poderá ser modificado ou emendado por consentimento mútuo entre as Partes, por via diplomática. As modificações e emendas entrarão em vigor nos termos do parágrafo 1 deste Artigo.

15. Qualquer uma das Partes poderá denunciar o presente Acordo, a qualquer tempo, por via diplomática. A denúncia terá efeito 90 (noventa) dias após a data de recebimento da notificação.
 
16. Qualquer controvérsia relativa à interpretação deste Acordo será resolvida de forma amigável pelas Partes por via diplomática.

Assinado em Brasília, em 26 de Abril de 2010, em dois (2) exemplares originais, em português e em inglês, sendo ambos igualmente autênticos.


AGREEMENT BETWEEN THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE GOVERNMENT OF THE BAHAMAS ON VISA EXEMPTION FOR HOLDERS OF DIPLOMATIC, OFFICIAL OR SERVICE PASSPORTS

and
The Government of the Bahamas
 (hereinafter referred to as “Parties”),

Compelled by the willingness to strengthen the relationship between the two countries;

Desiring to facilitate the entry into each other’s territory of nationals of each Party holders of diplomatic, official or service passports,

Hereby agree as follows:

Article 1

Citizens of either Party, holders of a valid diplomatic, official or service passport, not accredited in the territory of the other Party, may enter, exit, transit through and stay in the territory of the other Party, without a visa, for a period not exceeding 90 (ninety) days, from the date of entry.

Article 2

1.    Extension of the period mentioned in Article 1 may be granted by the competent authorities of the receiving country on the basis of written request by the Diplomatic mission or Consular post of the sending country.

2.    In case there is no Diplomatic mission or Consular post of one of the Parties, holders of diplomatic, official or service passports may consult the Consular Department of the Ministry of Foreign Affairs of the receiving country.

Article 3

Citizens of either Party, holders of a valid diplomatic, official or service passport, who are members of Diplomatic mission or Consular post accredited in the territory of the other Party, as well as their dependants who live with them and are holders of a valid diplomatic, official or service passport, may enter into, exit from, transit through or stay in the territory of the other Party without a visa during the period of their assignment, provided they have complied with the accreditation requirements of the other Party within 30 days after their arrival in the territory of the other Party.

Article 4

    Citizens mentioned in this Agreement may enter or exit the territory of the other Party through all border-crossing points open to international passenger traffic.

Article 5

    Citizens of either Party shall comply with the laws and regulations in force, during their stay in the territory of the other Party.

Article 6

    This Agreement does not curtail the right of either Party to deny entry or to shorten the stay of citizens of the other Party considered undesirable.

Article 7

    If a citizen of either Party loses his diplomatic, official or service passport in the territory of the other Party:

a)    the citizen shall inform the relevant authorities in the receiving country thereof and request appropriate action, and

b)    the Diplomatic mission or Consulate post concerned shall issue a new diplomatic, official or service passport or travel document to its citizen and inform the relevant authorities of the receiving country thereof.

Article 8

1.  The Parties shall exchange, through diplomatic channels, specimens of their valid diplomatic, official or service passports, mentioned in this Agreement, no later than 30 (thirty) days after the date of signature of this Agreement.

2. In case of introduction of new diplomatic, official or service passports or modification of the existing ones, the Parties shall exchange, through diplomatic channels, specimens of these passports, accompanied by detailed information on their technical aspects and applicability, not later than 30 (thirty) days prior to its application.

Article 9

    For reasons of security, public order or public health, either Party may suspend the application of this Agreement in whole or in part. Any such measure, as well as its revocation, shall be notified to the other Party, at the earliest possible time, through diplomatic channels.

Article 10

1. This Agreement shall be valid for an indefinite period of time and shall enter into force 90 (ninety) days from the date of the receipt of the second diplomatic note in which the Parties inform each other that the national legal requirements for entry into force of this Agreement have been met.

2. This Agreement may be modified or amended by mutual consent between the Parties, through diplomatic channels. The modifications or amendments shall enter into force as mentioned in paragraph 1 of this Article.

3.  Each of the Parties may, at any time, terminate this Agreement through diplomatic channels. The termination will be effective 90 (ninety) days after the receipt of the notification.

4.     Any dispute related to the interpretation of this Agreement shall be settled amicably by the Parties through diplomatic channels.

    Signed in Brasilia, on the 26th of April of 2010, in 2 (two) originals, in the Portuguese and English languages, both texts being equally authentic.
