MEMORANDO DE ENTENDIMENTO ENTRE O MINISTÉRIO DA AGRICULTURA, PECUÁRIA E ABASTECIMENTO DA REPÚBLICA FEDERATIVA DO BRASIL E O MINISTÉRIO DA AGRICULTURA DA REPÚBLICA DA GUIANA NA ÁREA DE SEGURANÇA FITOSSANITÁRIA DE PRODUTOS DE ORIGEM VEGETAL


Com o intuito de promover a comunicação e a cooperação bilaterais na área fitossanitária de produtos de origem vegetal, com vistas à proteção da saúde humana, animal e vegetal, o Ministério da Agricultura, Pecuária e Abastecimento da República Federativa do Brasil e o Ministério da Agricultura da República da Guiana, doravante denominadas "as Partes", após negociações amigáveis,


Chegaram ao seguinte entendimento:

1.    As Partes concordam em estabelecer mecanismo de consulta mútua na área de segurança fitossanitária de produtos de origem vegetal, em harmonia com os princípios, regulamentos, direitos e obrigações estipuladas no Acordo sobre Aplicação de Medidas Sanitárias e Fitossanitárias da Organização Mundial do Comércio - SPS/OMC, sujeitos a leis e regulamentos de cada país.

2.    As Partes procurarão solucionar as não-conformidades relacionadas a questões fitossanitárias, por meio do diálogo, da troca de informações e de consultas bilaterais e ainda através de um grupo de trabalho conjunto, de forma a assegurar benefícios mútuos, adotando as medidas incluídas neste Memorando de Entendimento de modo justificável, científico, transparente e consistente.

3.    As Partes concordam em estabelecer mecanismos para cooperação em áreas de fronteira, podendo uma das Partes, quando necessário e oportuno, solicitar apoio à outra Parte para execução de atividades de sanidade vegetal e certificação em cidades fronteiriças, respeitando-se a disponibilidade, a conveniência e as limitações legais de ambas as Partes. 

4.    Para a operacionalização das atividades citadas no item 3 deste Memorando, as Partes concordam em estabelecer um Plano de Trabalho Conjunto. O detalhamento deste Plano será realizado por ocasião de reunião bilateral ou entendimento prévio entre as Partes.

5.    Em caso de não conformidades na área de inspeção de produtos de origem vegetal que possam afetar o comércio bilateral, as Partes comunicarão e consultarão sua contraparte para encontrar, de forma expedita, a solução técnica necessária.

5.1.    Cada Parte estabelecerá um ponto de contato para implementar a comunicação bilateral, e notificará a outra Parte por meio de notas diplomáticas, incluindo a sua eventual substituição.

6.    A Parte que receber a cooperação será responsável pelas despesas relativas à participação dos técnicos  nas atividades previstas no presente Memorando de Entendimento, exceto quando acordarem de outra forma.

7.    As Partes deverão solucionar eventuais diferenças de compreensão ou de implementação do presente Memorando de Entendimento por meio de consultas amigáveis. O presente Memorando de Entendimento pode ser modificado com o consentimento por escrito das Partes.

8.    O presente Memorando de Entendimento entrará em vigor na data de sua assinatura e terá vigência por cinco (5) anos, automaticamente renovável por períodos consecutivos de cinco (5) anos, exceto quando uma das Partes denunciá-lo por notificação escrita com pelo menos seis (6) meses antes do término do período corrente de  cinco (5) anos.

Feito em Brasília, em 26 de abril de 2010, em dois exemplares originais, nos idiomas português e inglês sendo os dois textos igualmente autênticos.


MEMORANDUM OF UNDERSTANDING BETWEEN THE MINISTRY OF AGRICULTURE, LIVESTOCK AND FOOD SUPPLY OF THE FEDERATIVE REPUBLIC OF BRAZIL AND MINISTRY OF AGRICULTURE OF THE REPUBLIC OF GUYANA IN THE AREA OF PHITOSANITARY SECURITY FOR PRODUCTS OF VEGETAL ORIGIN


In order to promote bilateral communication and cooperation in the phitosanitary area, specially in what refers to products of vegetal origin, seeking to protect human, animal and vegetal health, the Ministry of Agriculture, Livestock and Food Supply of the Federative Republic of Brazil and the Ministry of Agriculture of the Republic of Guyana, hereinafter referred to as “the Parties” after friendly negotiations,

Have reached the following understanding:

1.    The Parties agree to establish a mutual consultation mechanism in the area of phitosanitary security for products of vegetal origin, in harmony with the principles, regulations, rights and obligations set up in the Agreement on the Application of Sanitary and Phitosanitary Measures of the World Trade Organisation – WTO/SPS, subject to laws and regulations of each country.

2.    The Parties will seek to resolve the differences arising from phitosanitary matters through dialogue, exchange of information and bilateral consultations, as well as through a joint working group, in order to grant mutual benefits, adopting the measures included in this Memorandum of Understanding in a justifiable, scientific, transparent and consistent basis.

3.    The Parties agree to establish mechanisms of cooperation in the border region, considering that any of the Parties, when necessary and convenient, may request support to the other Party in carrying out vegetal sanity and certification activities in bordering towns, taking into account the availability, the convenience and the legal limitations of both Parties.

4.    For the implementation of the activities mentioned in item 3 of this Memorandum, the Parties agree to establish a Joint Working Plan. The details of this Plan will be agreed upon either in bilateral meetings or after previous understanding between the Parties.

5.    Whenever the inspection concludes that there is a non-conformity of products of vegetal origin that can affect bilateral trade, the Parties shall work together in order to reach a necessary technical solution as soon as possible.

5.1.    In order to exchange information, each Party will establish a point of contact, whose designation, as well as further substitution, shall be notified by diplomatic channels. 

6.    The Party that receives cooperation will be responsible for the expenses of the experts participating in the activities envisaged in this Memorandum of Understanding, except when agreed differently.

7.    The Parties shall solve any differences in the interpretation or implementation of this Memorandum of Understanding by friendly consultations. This Memorandum of Understanding can be modified through written consent of the Parties.

8.    This Memorandum of Understanding will enter into force in the date of its signature and will remain in force for 5 (five) years, being automatically renewable for consecutive periods of 5 (five) years, except if denounced by one of the Parties, through written notification with, at least, 6 (six) months prior the end of the period of 5 (five) years.

Done in Brasilia, on 26th April 2010, in two original samples, in Portuguese and English languages, being both texts equally authentic.
